In the course of providing you with legal services, Ferris Law collects, uses and discloses personal information. We recognize the importance of this information and our applicable legal obligations.
As a law firm operating in Ontario, we are generally subject to the Personal Information Protection and Electronic Documents Act and have obligations pursuant to the Law Society of Upper Canada’s Rules of Professional Conduct, which require us to maintain the confidentiality of client information.
The Personal Information We Collect
Personal information is any information that identifies you, or by which your identity can be deduced. We collect, use and disclose such information to provide you with legal services. Wherever possible, we collect your personal information directly from you at the start of a retainer and in the course of our representation. In most cases, we shall seek your explicit consent to its collection, use, or disclosure. Sometimes, however, your consent may be implied through conduct.
Use and Safe-keeping of Personal Information
Ferris Law uses your personal information to provide legal services to you and to administer our client (time and billing) databases. We are obliged for legal purposes to retain our client files after the end of the retainer.
Ferris Law keeps all personal information in its care safe, secure and accessible to the person about whom the information belongs. To this end, we operate from secure premises, restrict file access to personal information, employ password protections and make use of a secure online, cloud-based service provider for file management and storage.
Disclosure of Personal Information
Under certain circumstances, Ferris Law will disclose your personal information:
– When required or authorized by law;
– When you have consented to the disclosure;
– When the legal services we are providing to you require us to give your information to third parties your consent will be implied, unless you tell us otherwise;
– When necessary to establish or collect fees;
– To provide flexible and cost-efficient services we may outsource certain functions. If we do so, the service providers we work with will be required to protect your personal information in the same manner as Vey Willetts LLP;
– If we engage expert witnesses on your behalf; or
– If the information is already publicly known.
Accuracy of Personal Information
Ferris Law is committed to the maintenance of accurate personal information. If you are aware of changes to the personal information you have given to us, inform us and we will update our records accordingly.
